Guardianships & Guardianship Alternatives

Our extensive experience in Guardianship proceedings, both simple and complex, gives us the ability to effectively guide clients through the process of filing for, contesting, or administering a Guardianship of the Person and/or the Estate. Most importantly, we also work to avoid establishing a Guardianship when it is not necessary.
In many cases, a Guardianship is the only way to protect a person and his or her property. Our firm strongly believes that Guardianships should always be a last resort, however, when all other alternatives have been thoroughly explored. If a Guardianship is necessary, our staff will assist as needed in administering the Guardianship to ensure that all ongoing and annual reporting requirements are met.   Anna M. Torres has a great deal of experience in serving as an Independent Third Party Guardian.  She works to resolve complex legal issues, assist law enforcement in pursuing perpetrators of financial exploitation of the elderly or disabled, and manage unusual, complicated, or large estates.  Anna also routinely serves as an Attorney ad Litem or Guardian ad Litem in Guardianships, as appointed by the Court.  We therefore commonly handle the following:

Probate

Our firm can assist you with the Probate process during the difficult and confusing time after a loved one’s passing. Probate is the court-supervised process to transfer an estate from a decedent to his or her beneficiaries.  Probate processes vary; depending on whether there was a will, whether there are debts or claims to be collected, and whether there is any disagreement among heirs.  The size of the estate, and the assets being distributed, can also effect probate. Standard Fees & Billing Policies

Our firm is happy to provide prospective clients with a listing of our standard fees and billing policies upon request. We will always do our best to ensure the maximum quality of representation at the lowest price, and hold ourselves to the highest ethical standards regarding billings. Our hourly rates are developed in accordance with the rates at which attorneys are compensated for legal fees and expenses in the Bexar County Probate Courts. Matters may be either a flat fee or billed at an hourly rate, and all cases require up-front payment or retainers prior to work commencing.
